Terms of Service Buy Part

These terms are applicable to the users of the website name naptor.com, and all subdomains, (hereinafter referred to as "Website" ) is owned by NAPTOR.

Your use of this website & services are governed by the following terms and conditions ("Terms of Use") including the applicable policies which are incorporated herein by way of reference.

If you transact on the website, you agree to be bound by the Terms of Use. You shall be subject to the policies that are applicable to the website for such transactions and/or access. By mere use of the website, you shall be contracting with NAPTOR ENTERTAINMENT LTD and these Terms of Use including the policies constitute your binding obligations with NAPTOR.

Definitions
1. "Affiliates" means any website operator, retailer, kiosk operator, direct marketing company, telemarketer, or operator of other direct marketing campaigns that has entered into an agreement with NAPTOR which compensates the affiliate for transactions resulting from business directed to the NAPTOR by the affiliate.
2. "Buying" shall mean purchase of any product by a Customer from NAPTOR.
3. "NAPTOR" includes NAPTOR ENTERTAINMENT LTD.
4. "Cookies" means small text files which our website places on your device to store information about your shopping session and to identify your device.
5. "Customer" means a person or organisation that buys, sells or exchanges products with NAPTOR online.
6. "Exchange" shall mean an act of giving one thing and receiving another in consideration to cash, kind or donation.
7. "Personal Information" means the details provided by you on registration or at the time you become a member and/or any subsequent information that you provide after or before the registration;
8. "Product/s" mean chattels real (movable property) bought, sold or exchanged between a Customer and NAPTOR, and also those products that are sent to NAPTOR for sale but for which transaction has not yet been completed
9. "Product Description" means that part of the website where the description of the particular product is provided.
10. "Selling" shall mean any product sold by a Customer to NAPTOR.
11. "User" means a person who uses or accesses this website and/or is a Customer.
12. "Website" means the website located at naptor.com and its subdomains and any subsequent URL which may replace it.

PART - I (General)
1. Product Warranty
1.1 12-Months Warranty : NAPTOR offers a 12 month warranty on all items except consumables. Please note, consumables e.g. batteries will be covered for 30 days only. This warranty does not cover physical damage, liquid damage, or any damage caused by rooting/ jailbreaking a device, and only covers software faults arising in the course of normal use.

1.2 NAPTOR bears no responsibility for your loss of data, please ensure that all data is removed from the device before booking in for warranty or returning the device.

1.3 If the product sold by NAPTOR is found to be faulty or develops a fault within the first 30 days of sale NAPTOR will refund to the original value and payment method.

1.4 If the product develops a fault after 30 days and within 6 months of sale, NAPTOR will repair or replace the product. If you have already had a repair/replacement that has become faulty again, the refund processed would be to the original value as per the Terms of Use.

1.5 If the product develops a fault after 6 months and before 12 months from the date of sale, NAPTOR will replace/repair the product. If you have already had a repair/replacement that has become faulty again, the refund processed would be to current value as per the Terms of Use.

1.6 All products sent to NAPTOR for refund or return under warranty are made pursuant to a shipment contract. Prior to NAPTOR receiving such products the risk of loss and title for such products remains with the Customer.

1.7 This warranty does not cover physical damage, damage or failures which result from accident, misuse, abuse, neglect, mishandling, misapplication, faulty installation, improper maintenance, and improper voltage supply, interference from or with other electronic devices, alteration, improper modification, firmware flashing, bios flashing or service by anyone other than NAPTOR or an agent approved by NAPTOR.

2. Returns policy
2.1 NAPTOR will only accept Products returned that are:

(a) Returned Products to NAPTOR should contain all items included in the original Product.

2.2 All returned Products need to be tested and the fault verified before any refund, repair or replacement can be issued.

3. Unwanted product policy :
Customer is entitled to return an Unwanted item within 48-hours of sale for a full refund to a NAPTOR voucher. Refund will be subject to testing and if the item is returned in the same condition as sold. In order to prevent abuse, NAPTOR reserve the right to limit the number of exchanges from a specific customer.

4. Description of Products: All Products are second hand unless specifically stated and all Product descriptions and images are for display purposes only and do not represent the finished Product.
4.1 Box contents may vary; additional downloadable content listed on the box may not be included.NAPTOR cannot confirm the price of a product until your order is accepted in accordance with our policies.

4.2 Images - images are for illustration purposes only. Actual product design may vary from image.

4.3 Condition of products - the price will vary depending on the cosmetic condition of the Products and its accessories. We break this down into grades:

Grade A - Mint condition
Grade B - Good condition
Grade C - Working condition

4.4 NAPTOR reserves the right to amend prices anytime without prior notice.

4.5 All Apple devices must have their iCloud account deactivated. It is the responsibility of the Customer to ensure the device is clear of any accounts, passwords or any other personal information before NAPTOR accepts responsibility.

5. Buying from NAPTOR
5.1 You hereby acknowledge your sole responsibility to ensure that you have the relevant compatible accessories, suitable power step-downs, equipment, software, display devices and relevant machinery or otherwise needed to safely connect the products to power supplies, mains power, batteries and other devices.

5.2 For the purposes of maintaining appropriate demand and supply and ensure 'natural' price fluctuations and stock availability for the benefit of all our customers, NAPTOR reserves the right to limit the number of units of any particular item, sold to any individual customer, at any time.

6. Selling to NAPTOR
6.1 NAPTOR reserves the right to refuse to purchase of any Product at their sole discretion. NAPTOR reserves the right to limit the number of purchases at their sole discretion.

6.2. Any stolen, blocked, counterfeit or fake devices sent to us will be reported to the police. No payment will be made and the device(s) will not be returned. 

6.3 Once you sell your Products to NAPTOR, the ownership will be transferred to NAPTOR.

6.4 Please note that prices quoted on our website are subject to change without prior notice.

6.5 Obligation to wipe data: It is the sole responsibility of the Customer to ensure that any device sold to NAPTOR is clear of any personal information. The Customer would use all reasonable measures to wipe/erase the data on the device or any additional storage device included in that device.

6.6 I understand that if the device is found to have liquid damage or physical damage, it may be subject to a revised offer which you will have the choice to accept or have the device sent back free of charge. 

7. Registration/Membership
7.1 You warrant that:

7.1.1 The personal information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects.

7.1.2 You will update your account to reflect any changes to your personal information.

7.1.3 You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

7.2 If you wish to sell or exchange products you must become a NAPTOR member and in doing so, agree to be bound by the additional terms and conditions of membership . For more information please refer to our membership requirements here.

7.3 You may only have one NAPTOR account. If you hold more than one Online account with NAPTOR the most recently created account will be considered valid and all pre-existing accounts will be suspended.

7.4 I agree to OPT-IN to NAPTOR newsletters, and ( i ) am able to OPT-OUT at any time. 

8. Intellectual Property Rights
8.1 Copyright

All content included on the NAPTOR website , such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of NAPTOR or its content suppliers and protected by UK and international copyright laws.

8.2 Trademarks

NAPTOR and other marks indicated on NAPTOR's website are registered trademarks of NAPTOR, or its subsidiaries, in the UK and other countries. NAPTOR and other graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dress of NAPTOR or its subsidiaries.

9. Export Limitation
Certain Products sold by NAPTOR may have been purchased from outside the United Kingdom under certain agreements that restrict or forbid subsequent re-exportation from the United Kingdom. The Customer will not export any Product sold by NAPTOR without first obtaining all appropriate approval from the relevant authorities.

10. Limitation of Liability
10.1 While NAPTOR will use reasonable endeavours to verify the accuracy of any information on the website, NAPTOR makes no warranties, whether express or implied in relation to its accuracy.

10.2 NAPTOR will not be liable, in contract, tort for:

Any economic losses
Any loss of goodwill or reputation
Any special or indirect losses suffered by the User as per the Terms of Use
10.3 NAPTOR's liability whether in contract, tort or otherwise in respect of any defect in the Products or for any breach of the Terms of Use or of any duty owed to the Customer in connection herewith shall be limited in the aggregate to the price of the Products in question.

11. Severance
If any part of the Terms of Use shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms of Use and shall not affect the validity and enforceability of any of the remaining provisions.

12. Indemnity
You agree to indemnify NAPTOR fully from any third party claims arising out of your negligence.

13. Notice
13.1 Any notice given under or pursuant to these Terms of Use may be sent by hand or by post or by registered post or by recorded delivery. It would first be received by the addressee in normal business hours.

16. Age Restrictions
16.1 The Customer placing orders or making purchases, confirms that he/she is of the appropriate age to receive and view the specified certification of the title(s) of the Product he/she has ordered/purchased.

16.2 Any Customer ordering or purchasing a Product for or on behalf of a third person shall need to make sure that the intended recipient of the order is of the appropriate age to receive and view the specified certification of the title(s) he/she has ordered/purchased.

16.3 If you are under 13, you may use the website only with involvement of a parent or guardian.

19. Force Majeure
NAPTOR shall not be liable for any default due to any Act of God, war, strike, lockout, industrial action, fire, flood, drought, storm or other event beyond the reasonable control of NAPTOR.

PART II ( SELLING TO NAPTOR

20. Sending products to NAPTOR
20.1 I will ensure that all payment information (PayPal Email Address, Account name, Sort Code and Account number) are correct. NAPTOR does not validate the details provided and cannot guarantee the receiving bank validates the details for the payment instruction. Any error in these payment details may result in a loss of funds. To the extent permitted by law, NAPTOR is not liable for loss arising from any error in instructions given or by an authorized user.
20.2 NAPTOR is not liable for items that may be lost during transit by Royal mail Post,  You have the option to send via Post Registered or Postal Address, at an additional cost – we highly recommend this for speed and reliability. 
20.3 I am the sole and rightful owner of this mobile phone being sold to NAPTOR ENTERTAINMENT LTD. If any devices(s) that I trade in turn out to be lost or stolen, I will waive my right to be paid. 
20.4 Any stolen, blocked, counterfeit or fake devices sent to us will be reported to the police. No payment will be made and the device(s) will not be returned. 
20.5 I understand and agree that all data stored on the device may be deleted and will be unrecoverable. 
20.6 Any such items that are sent with the phone such as charger(s), external covers, usb devices, micro-usb cards and sim cards will be either recycled or disposed of. Any such items will not be returned in the case that the final assessment is rejected for any reason.
20.7 NAPTOR has the right to reject the initial online trade in offer if the device has found to have missing/aftermarkets parts and/or has been tampered with by an unauthorised repair agent. This  includes the unauthorised software upgrades also known as “jailbroken” for Apple iPhones and “rooted” for Android phones. 
20.8 If there are any issues with your device we will contact you via email and phone to make a revised offer. If we receive no response within 14 days of making the revised-offer, we will proceed with payment for the revised price.

Each mobile phone or device sold should match the make and model in the sale order and meet the following conditions:

CAT A
Each device should be:

Be fully functional*
Be in good condition (minor to none wear and tear – no cracks, chips, dents, deep scratches or engraving)
Have no defects in screen (no pixel damage, defects or discolouration in LCD)
Include its battery and back cover (charger not required)
Have healthy battery (battery health must be 80% or greater)
Not have bent housing
Not be water-damaged (water indicators must not be red)
*Must turn on and off, with all buttons and ports undamaged and working. All features such as Making calls, Wi-Fi, Camera, Video, etc must work. Operating system (software) must be fully working. Screen and touchscreen must fully work. Battery capacity must be very good.

CAT B
Each device should:

Be fully functional*
Have no major damage (minor to moderate wear and tear - no deep scratches, marks and small cracks, chips or dents)
Have no major defects in screen (no pixel damage, defects or discolouration in LCD)
Include its battery and back cover (charger not required)
Have decent health battery (battery health must be 80% or greater)
Not have bent housing
Not be water-damaged (water indicators must not be red)
*Must turn on and off, with all buttons and ports undamaged and working. All features such as Making calls, Wi-Fi, Camera, Video, etc must work. Operating system (software) must be fully working. Screen and touchscreen must fully work (even if damaged). Battery capacity must be good.

CAT C
Each device should:

Be fully functional*
Have no major damage (moderate wear and tear - no deep scratches, cracks, chips or dents)
Have no major defects in screen (no pixel damage, defects or discolouration in LCD)
Include its battery and back cover (charger not required)
Have decent health battery (battery health must be 70% or greater)
Not have bent housing
Not be water-damaged (water indicators must not be red)
*Must turn on and off, with all buttons and ports undamaged and working. All features such as Making calls, Wi-Fi, Camera, Video, etc must work. Operating system (software) must be fully working. Screen and touchscreen must fully work (even if damaged). Battery capacity must be good.

FAULTY PHONE/DEVICE
Each device should:

Include its battery (charger not required)
Be intact (not crushed or snapped in half)
Not have bent housing
Not have any missing parts or components
Faulty examples: Water damaged, Shattered touchscreen, Major defect in screen, Faulty operating system, Faulty camera, Faulty touchscreen, Faulty Wi-Fi, Poor battery capacity, Faulty charging port, etc.

All devices must not be activation locked and must be deregistered from any associated accounts. All phones and devices must be on a UK network or not locked. Phones or devices locked to a foreign network will not be accepted.
